JOSEPH R. SWEE
Joseph Swee's practice encompasses a broad range of complex commercial litigation,
including matters involving breach of contract, breach of fiduciary duty, control and
partnership disputes, business torts, and disputes involving restrictive covenants and
misappropriation of confidential information. Mr. Swee has successfully represented clients
in a number of federal and state courts as well as AAA, JAMS, and FINRA arbitrations.
Mr. Swee joined Scandaglia Ryan in February 2018 following a clerkship with the Honorable
Jeffrey T. Gilbert of the United States District Court for the Northern District of Illinois. Prior to
that, Mr. Swee received his J.D. in 2015 from The John Marshall Law School, graduating
summa cum laude. During law school, he was a legal extern for the Honorable Robert W. Gettleman, the
Honorable Harry D. Leinenweber, and the Honorable Daniel J. Pierce.
Representative Matters
- Represented ownership of luxury hotels in New York and California in a dispute against the brand manager related to
mismanagement and termination of the management contracts, which included arbitration before the American
Arbitration Association and litigation in New York federal court
- Represented investors against a European parent company and its international and domestic subsidiaries in an ICDR
arbitration involving contract and fiduciary duty claims arising from the restructuring of a large real estate
development project in Chicago
- Represented an owner of a tax credit financing business in a business control dispute in the Delaware Court of
Chancery involving the removal and replacement of the firm's manager
- Represented a national paper goods and gift retailer before the Illinois Appellate Court in a breach of contract dispute
arising out of a leasing and co-tenancy arrangement
- Represented financial advisors for a large financial services company in FINRA arbitrations against claims involving
restrictive covenants and alleged misappropriation of confidential information and trade secrets
- Represented an owner of a boutique St. Louis hotel in a Missouri state court action involving claims for breach of
fiduciary duty and conspiracy based on alleged mismanagement of the hotel
- Represented an owner of a tax credit financing business in an Illinois state court action involving claims for breach of
fiduciary duty and conspiracy based on the alleged diversion of company assets
- Represented the owner of a luxury hotel in New York in federal litigation involving breach of contract, indemnity, and
negligence claims arising out of defective work performed by contractors during the renovation of the hotel
- Represented the owner of a luxury resort and related parties in California state court against contract and tort claims
arising from the termination of a service provider at the property
- Represented an ultra-high-net-worth individual and a related entity in federal and state courts against palimony and
related claims
- Represented a multinational toy company in federal litigation involving claims for breach of contract and infringement
against a former licensee and related defendants
- Represented a multinational toy company against a mobile game development company in a JAMS arbitration
involving claims for breach of contract and infringement arising out of the development of a mobile game using the
toy company's intellectual property
- Represented the former owner of a mortgage company in federal litigation against claims brought by the federal
government under the False Claims Act and FIRREA
- Represented a large food services company in a federal grand jury investigation of alleged fraud in government
contracting
- Represented a paving company in an antitrust investigation by the Illinois Attorney General related to an alleged
refusal to deal
- Represented an attorney in a proceeding before the Illinois Attorney Registration & Disciplinary Commission
